Public Notice 

The public will take notice that the Wendell Board of Commissioners has scheduled five public hearings on Monday, February 10, 2020 at 7:00 p.m. in the Wendell Town Hall for the following purposes:

  1. The first public hearing is to consider a Zoning Map Amendment request to rezone 23 acres (PIN #1784-69-5299) located at 0 Marshburn Road from Wake County Residential-40 (R-40) to Rural Agricultural (RA).
  2. The second public hearing is to consider a Zoning Map Amendment request to rezone two parcels totaling .61 acres [.21 acres (PIN #1784-71-2467) located at 313 N. Pine Street and .4 acres (PIN #1784-71-1388) located at 230 N. Main Street] from Residential-2 (R2) to Downtown Mixed-Use (DMX).
  3. The third public hearing is to consider a request by Chris Rurkowski of TMTLA Associates to rezone approximately 129.59 acres of property along Rolesville Rd within the parcels identified by PIN #1765852510, PIN #1765962276, PIN #1765856251 and PIN #1775042139 to an R4 Conditional District. The described properties are currently zoned Wake County R-40.
  4. The fourth public hearing is to consider a Special Use Permit request by James A. Harrell III on behalf of Wendell/Larue, LLC for a multifamily community at 0 Wendell Blvd. (Behind Industrial Drive), PIN #1784-32-6835.
  5.  The fifth public hearing is to consider a Zoning Text Amendment to Section 12.8Q of the UDO as it relates to Mural requirements.

The public will take notice that a public hearing has been scheduled for Tuesday, December 10, 2019 at 6:00 p.m. at the Wendell Town Hall (15 E. Fourth St.). The purpose of the hearing is for the Board of Adjustment to consider a variance request submitted by Shanel Goodson and Marisha Beason for property located at 0 Wendell Falls Parkway (PIN #1773 66 9505). The variance request is to Sections 9.3 and 9.5 of the UDO as it relates to road improvement requirements.

PUBLIC NOTICE 

BE IT RESOLVED that, the Town of Wendell does hereby declare its intent to close the alley located between East Campen Street and Third Street right-of-way, being approximately 3,000 square feet and located in downtown Wendell in the town limits, bordering the lots identified by PINs # 1783-79-0912, 1783-79-0912, 1783-79-0956 and 1783-79-1911.

BE IT FURTHER RESOLVED that the Board of Commissioners hereby orders that a public hearing on this matter be held on Monday, November 25, 2019 at 7:00 p.m. in the Wendell Courtroom, following the public notice of intent as required by §160A-299.

            Duly adopted this 28th day of October 2019.

  • Public hearing to consider a Zoning Text Amendment to Sections 2.3, 3.3 and 19.3 of the UDO as it relates to Indoor Amusements, Game Rooms and Pool Halls. Public hearing held; continued to the June 24, 2019 meeting for Board action.  Approved on 6/24/2019.  
  • Public hearing to consider a Zoning Text Amendment to Sections 2.3, 3.3 and 19.3 of the UDO as it relates to short term rentals, specifically Bed and Breakfast Inns, Homestays and Whole-house Lodging.  Public hearing held; continued to the July 8, 2019 meeting for Board action.  Failed on 7/8/2019.
  • Public hearing to consider a Zoning Text Amendment to Section 10.4 of the UDO as it relates to parking requirements. Public hearing held; second reading at the June 24, 2019 Board meeting.  Approved on 6/24/2019.

PUBLIC HEARINGS are legislative. Persons speaking will have five-minutes. 

QUASI-JUDICIAL [EVIDENTIARY] HEARINGS - Quasi-judicial hearings are different than regular public hearings in that they resemble a court hearing where testimony is presented. The Town Board refrains from “ex parte communication” about these cases, as they must make a decision based solely on the written and oral evidence actually presented at the hearing itself. This means that the Town Board refrains from receiving any information about these cases outside the hearing, including emails, phone calls, letters, etc. The Town Board also refrains from conducting meetings about these issues outside the hearing. 
These same prohibitions do not apply to staff. Staff welcomes inquiries from the public about any of these cases.
